Storage, transmission, or presentation of any information, data or material in violation of any United States law is prohibited. This includes, but is not limited to; copyright material, material we judge to be a threat or obscene, or material protected by trade secret and other statute. The customer agrees to indemnify and hold Virtual Convenience harmless from any claims resulting from the use of the service, which damages the customer or any other party
Prohibited Content and Sites
Customer agrees to use our Services only for lawful purposes, in compliance with all applicable law. ACTIVITIES THAT ARE PROHIBITED BY VIRTUAL CONVENIENCE, BUT ARE NOT LIMITED TO:
- Misrepresenting or fraudulently representing products and/or services. Threatening harm to persons, property or otherwise harassing behavior.
- Unsolicited bulk email
- Profanity in the site(s) content, including domain name.
- No material that provides, sells or offers to sell the following: illegal drugs - including export or import of illegal drugs, controlled substances, pirated materials, obtaining or assembling illegal goods or weapons to attack others.
- Pornographic martial, nudity, sexual products, programs or services including escort services.
- Information used to break, copyright, violate the trademark of or destroy property or information.
- Information used to illegally harm animals or people.
- Proxy services including both public and private use.
- Sites that promote any illegal activity or present content that may be damaging to our servers or any other server on the Virtual Convenience network.
Abuse
Virtual Convenience reserves the right to suspend, refuse or terminate any service provided at our sole discretion, without notice. Virtual Convenience will not under any circumstances be responsible for consequential damages. If you discover anyone using our service for spam or otherwise abusive behavior, please get in contact with abuse@virtualconvenience.com. If a staff member deems the website against our TOS, proper action will be taken.
Engaging in any activity that, in Virtual Convenience's sole and absolute discretion, disrupts, interferes with or is harmful to (or threatens to disrupt, interfere with, or be harmful to) the Services, Virtual Convenience's business, operations, goodwill, customers and/or customer relations, or the ability of Virtual Convenience's customers to effectively use the Services is prohibited. In addition, the failure by a Customer to cooperate with Virtual Convenience in correcting or preventing violations of this Usage Policy by, or that result from the activity of, a customer of the Customer is a violation of this Usage Policy.
Customer Responsibility
The customer is responsible for all activity originating from the account unless proven to be a victim of outside hacking. The customer is responsible for securing their user name/password. The customer assumes responsibility for all material on their site that may be put on by a third party.
Backups
Backups of new/changed data are made nightly and full backups are made weekly. No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. Backups are made for server restoration purposes only. The customer is responsible for keeping a complete and current copy of their website files as backup on a remote system (not on Virtual Conveniences' servers). Virtual Convenience is not responsible for any lost files, information, or data. If data loss occurs due to negligence of customer in securing their account or by an action of the customer, Virtual Convenience will attempt to recover the data from the most recent archive for a fee. Using an account as an online storage space for archiving electronic files is prohibited.
IRC
We currently do not allow IRC or IRC bots to be operated on our servers.
Information Obtained from Electronic Means and 'Cookies'
Many websites, including this one, collect information about your computer and your IP address. You must assume that your web-viewing or web-use activity is monitored, tracked, and information collected. This information is not usually of a personal nature, but it may help define your viewing habits and product preferences even though the website may or may not have any idea who you are. Websites use cookies to keep you 'logged in', to keep track of search criteria, to monitor use, to password protect use of the site or use of products sold by the site.
Information That Is Not Shared
We will do everything in our power to ensure your right to privacy. We are committed to developing long lasting relationships that are built on trust. Personal data transmissions are encrypted when you order from Virtual Convenience, all your personal information is protected. We use Secure Sockets Layer (SSL), the industry standard, for encrypting all personal information, including name, address and credit card numbers. Virtual Convenience will not under no circumstance sell Your personal information.
Right to Damages
Virtual Convenience reserves the right to collect damages from the violating party if any harm is done to Virtual Convenience, including our system, servers, connectivity, business, service, reputation, operations, or equipment, which requires (software, hardware or man hours) repair or reconfiguration of any kind.
Account Ownership
Virtual Convenience is only responsible to the present owner of the web hosting space and bandwidth. We verify ownership by name, address, e-mail address, user name, and password. If you give this information to any other party or give access to your e-mail address on your account to another party, you risk having your website and any other information on your account changed and/or deleted. Virtual Convenience is not responsible for any information on your account should you reveal this information to another party who causes damage to your account and/or website. If you are a web designer and you are not the person paying for the hosting account, we advise you to receive payment for your work before you publish it to our servers. Once the website is published to our servers the account owner has retained ownership of that content.
Server Scripts Policy
You are free to use any script (CGI, PHP, etc.) you wish, however we reserve the right to disable any script that effects normal server operation or service to other Virtual Convenience customers. For the protection of all our customers, we also reserve the right to discontinue service to those customers who continue to run scripts that effect normal server operation.
Cancellation of Service/Refund
In the first 30 days - you may cancel your web hosting service for a full refund anytime within the first 30 days of the set-up date. Only authorized persons can cancel an account. All refunds are in $US dollars. Monies are not adjusted due to international currency value fluctuations. Refunds are issued 30 days from receiving notice of cancellation. The customer is responsible for removing all website files and e-mails from our servers prior to cancellation. After a cancellation request, Virtual Convenience reserves the right to delete all website files and e-mails related to the account without notice. For customers who registered a new domain name with the account, $10 will be deducted from the refund for the cost of the domain. You will maintain full ownership of the new domain after you have canceled your hosting with us. Virtual Convenience will no longer cover further registration fees associated with the domain name. After the first 30 days - client is bound by the contract term. You are welcome to cancel your service anytime; however you will not receive a refund it is before the term of the contract. Upon receiving notice of cancellation, we will delete all website files and e-mails related to the account without notice. The client is responsible for removing all website files and e-mails from our servers prior to cancellation.
If an account is terminated for a policy violation, there will be no refund. Virtual Convenience reserves the right to delete the policy violating website content without notice.
Limited Liability
VIRTUAL CONVENIENCE SHALL NOT BE LIABLE FOR NONPERFORMANCE OR DELAY IN PERFORMANCE CAUSED BY ANY REASON, WHETHER WITHIN OR OUTSIDE OF ITS CONTROL. IN NO EVENT SHALL VIRTUAL CONVENIENCE BE LIABLE UNDER CONTRACT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER LEGAL OR EQUITABLE THEORY FOR ANY DIRECT, INDIRECT, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF USE, LOST PROFITS, LOSS OF DATA OR INFORMATION OF ANY KIND OR LOSS OF BUSINESS GOODWILL OR OPPORTUNITY) WHETHER OR NOT VIRTUAL CONVENIENCE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGES. VIRTUAL CONVENIENCE WILL MAKE EVERY EFFORT IN GOOD FAITH TO ENSURE THAT ITS WEB SERVERS ARE AVAILABLE TO USERS AS FAST AS POSSIBLE AND THAT THERE IS MINIMAL INTERRUPTION OF SERVICE.
Billing Cycle
There are 3 billing cycles: semi-annually, annually, or biannually (2 years). All services are provided on a pre-payment basis. Virtual Convenience accepts credit card and/or PayPal payments. All under a secured environment (256 bit encryption).
Billing Notification
Customers will receive a notice via e-mail as to when their billing cycle ends. Unless a special arrangement has been made, all notifications of billing will occur through email. Or you can simply log into your client area at www.virtualconvenience.net/billing to view your invoices.
Indemnification
Customer agrees to defend, indemnify and hold harmless Virtual Convenience against any liabilities arising out of defective products sold to customers from Virtual Convenience, personal injury or property damage caused by products or services sold or distributed from Virtual Convenience servers, any material that infringes or allegedly infringes on the rights of a third party available from Virtual Convenience servers, and any material that libels or allegedly libels a third party available from Virtual Convenience servers. Virtual Convenience reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In that event you shall have no further obligation to provide indemnification for Virtual Convenience in that matter.

Virtual Convenience website properties may contain technical inaccuracies or typographical errors. Changes to Virtual Convenience's website properties may be periodically made. Every effort in good faith will be made to keep the website content accurate and up to date. Virtual Convenience reserves the right to make improvements and/or change our web site at any time without notice. Virtual Convenience disclaims all warranties or conditions, implied, expressed or statutory including but not limited to, warranties or conditions of quiet enjoyment and non-infringement. Virtual Convenience does not guarantee that users will be able to use the services at times or locations of their choosing. Virtual Convenience's Right to Suspend or Cancel Account
Virtual Convenience reserves the right to suspend or cancel service to a customer at any time without notice, for any reason, including, but not limited to, refusal or failure to pay for services provided or by sole judgment of Virtual Convenience that the customer may be performing activities harmful to Virtual Convenience or its customers, employees, affiliates or any other users of Virtual Convenience. Virtual Convenience reserves the right to cooperate with law enforcement and other authorities in investigating claims of illegal activity.
